  • Chapter 7 Bankruptcy: Chapter 7 bankruptcy is what folks traditionally think of when they hear the word “Bankruptcy.” The Chapter 7 bankruptcy process generally takes 90 days from start to finish. Once your case is filed, you attend one court date, approximately 30 days after your case is filed. Another 60 days after that court date, you will receive your discharge order from the bankruptcy judge, which formally wipes out your debt and gives you a “fresh start.” Filing a chapter 7 bankruptcy wipes out most of your unsecured debts (i.e. credit cards, personal loans, payday loans, medical bills). There are a handful of unsecured debts that generally cannot be wiped out in chapter 7, such as student loans, domestic support obligations, taxes, fines, and criminal restitution. When you file for chapter 7 bankruptcy protection and you have a secured debt (e.g. car note or mortgage), you generally have the option to surrender the collateral to the creditor and wipe out the remaining balance owed, or keep the collateral and resume payments to the lienholder. Also, in chapter 7, if you have any “big-ticket items,” such as a house or vehicle with a lot of equity, the chapter 7 trustee can take such assets, sell them, and use the proceeds from the sale to pay off your creditors. Finally, if your income exceeds a certain threshold, the bankruptcy court may not allow you to file for chapter 7 protection at all, and you will have to file a chapter 13.

  • Chapter 13 Bankruptcy: Chapter 13 bankruptcy is considered a voluntary repayment plan of some or all of your debts over the course of three to five years. In short, a chapter 13 bankruptcy helps you keep your stuff. For individuals who have fallen behind on their car note or mortgage, and are in jeopardy of repossession or foreclosure, chapter 13 bankruptcy is your better option. A chapter 13 bankruptcy hits the pause button with a legally binding court injunction, gives you breathing room, and allows you three to five years to catch up on your payments. Under certain circumstances, your contractual obligation to your lienholder (whether it be the car lender or the mortgage company) can be modified to your benefit. A chapter 13 bankruptcy also addresses other types of debts that cannot be addressed in chapter 7 (such as tax debt). In addition, All of your assets are completely protected once you file for chapter 13 bankruptcy. Neither the court nor the trustee can liquidate your assets.

  • Foreclosure: Sometimes folks have a string of bad luck, and their mortgage payments fall by the wayside in order to pay for more immediate concerns. If you have fallen too far behind on your mortgage and cannot afford to get caught up, your mortgage company may begin foreclosure proceedings. He can put you on a payment plan to catch up on your mortgage payments without breaking the bank.

  • Garnishment: Once a creditor sues you and obtains a judgment against you, it is only a matter of time before they start to garnish your wages, and your take-home pay will only be a fraction of what it once was. Don’t wait until it is too late – once your bankruptcy is filed, Maxwell can squash that garnishment right away.

  • Repossession: Filing for Chapter 13 Bankruptcy Protection can stop a pending repossession dead in its track. Even if your car has been repossessed, Maxwell may still be able to recover it for you but it’s imperative that you immediately file for Chapter 13 Bankruptcy Protection.
